What is FDCPA?

Protecting Your Rights

If you are struggling with large amounts of debt, you are probably experiencing the humiliating occurrence of having debt collectors calling your home and your work day and night. What you may not be aware of is the fact that it is illegal for debt collectors to harass debtors in their pursuit to collect payment. The FDCPA, the Fair Debt Collection Practice Act, is a law that Congress passed in 1978 to protect consumers from the inappropriate and underhanded methods that debt collectors use to obtain payments for the debts that are owed them. If you are being harassed by debt collectors, contact our firm today to discuss your options and to put an end to the harassment.

The FDCPA prohibits many of the common behaviors that debt collectors have been known to use, including the following:

  • Contacting debtors at odd/inconvenient hours (traditionally described as before 8 am and after 9 pm)
  • Using profane or abusive language when speaking with debtors
  • Contacting debtors at their place of work, after the debtor's employer has expressly asked for this not to occur
  • Threatening debtors with lawsuits, if no such suit is actually intended
  • Telling debtors that they have committed a crime, or threatening them with arrest/jail time
  • Contacting the debtor's friends or family to discuss their debt
  • Impersonating law enforcement officers in order to collect a debt

This is not a complete list of prohibited behaviors. If you believe you are the victim of debt collector harassments, contact an attorney to discuss your case and to put an end to the harassment.
